Pittsburgh Criminal Lawyer Criminal Record for Summary Offenses?
I was recently received a non-traffic citation summons for public drunkenness and criminal trespass in Pittsburgh, Pennsylvania. I was walking to a friends house in an unfamiliar part of town. The road I was walking on did not have a sidewalk so I was on the edge of the road. I had been drinking but I was not given any type of sobriety test. I was simply lost and did not realize that I was in any way trespassing by walking along the edge of the road.
I have been told that the maximum fine is $300, which is less than hiring a lawyer. However, it is important to me to maintain a good record. I will be starting med school next year and I would be very embarrassed to tell the school about this incident or any future employers. If I plead guilty will this show up on a background check. Is it likely that I will be able to get the charges reduced/dropped with a lawyer because I have no previous offenses? Thanks.
Where I practice, California, the answer is yes. Your goal will be to complete an alcohol program in exchange for the dismissal of the trespass. If you complete the alcohol program and pay the fine, you will be requesting the public drunkenness dismissed. This is commonly called “diversion.” Diversion is where the DA agrees to continue the case to give you enough time to complete a program and then dismisses it or proceeds depending on how well you do.
However, in view of your circumstances, it might be worth your while to hire an attorney, even though an attorney will cost more than the fine. Of course, there is nothing wrong to ask the judge and DA what they will do. If you don’t like what you hear, if its different from the diversion I described above, then you can ask for time to hire a lawyer. The value of protecting your record is worth more than the fee to hire a lawyer when you take your aspirations into consideration.
