I Was Charged With a Dwi With a Suspended License – What Sentence Will I Expect?

If you have been charged with a DWI with a suspended license, you can generally expect a stiff sentence. In most states this means a mandatory jail sentence, and certainly needs the skills of a dedicated DWI lawyer.

The fact that you will be charged in any case due to your driving (with or without drink) with a suspended license is immaterial: the DWI charge compounds the problem, and you could even be charged under two codes. You could be jailed, face a heavy fine and lose your license for an even longer time. The sentencing here is up to the court. If you are fortunate, then part of the jail time could be traded for a period of probation, though ten years probation with this type of deal is not unusual.

Now, perhaps, you are beginning to understand the gravity of this offense, and to face this without the services of the best DWI attorney experienced in this kind of charge would be tantamount to suicide. You probably feel suicidal in any case, but don’t despair. A good DWI lawyer can help you more than you think, and help to reduce the sentencing by presenting you as being a bit foolish and unaware of your suspended license.

That requires copies of court records, and if your DWI attorney demands to see them in court, then they must be provided there and then along with proof that you had signed for any communication to indicate that you had actually received the notification. The more time that has elapsed in the ten years to the ‘washout’ of your conviction, then the more difficult that will be for them to produce.

If the notice of conviction and sentencing of a suspended license was posted to you through the normal mailing system, and you hadn’t signed for it, then it will be difficult to prove that you actually received it. It is not up to you to request this of the court after your conviction, and it is not unusual for such cases to be dismissed because the prosecution cannot prove “Beyond Reasonable Doubt” that you had been informed that your license had been revoked or suspended.

What happens then depends on the charge being made. If it is driving under the influence of alcohol while suspended from driving, then the case is dismissed, and you go free. If it is a simple DUI charge, with your suspended license to be taken into account during sentencing, then you might still be guilty, but the suspension can’t be taken into account. However even the guilt could be in doubt with a good DWI attorney.

As to the expecting sentencing if you are found guilty of knowingly driving under the influence of alcohol while banned from driving, you will likely be jailed if found guilty. The term will depend upon the judge, and also the alcohol content of your blood. Don’t expect any understanding or sympathy from the bench, and if your previous ban was also for a DWI offence, then you had better be prepared for a long time in prison, unless you have chose your DWI lawyer wisely.

Such cases can be won, and it is best to fight them, but only if your legal team knows its stuff. Search the internet and ask around your family and friends: this is not the time to be ashamed to talk to them since it could make a world of difference to your sentence. I had a drinking problem when I was in high school and made some really bad choices. I got 2 dui’s in the same year.They are both misdemeaners. I know you have to wait till your off probation and have all the treatment and fines paid. Just wonder anyone knows if I got a shot. ILL have a bachelors degree the same year ill be off probation. You have an alright shot at it, it just depends on whether you get a waiver which depends on too many local circumstances to know beforehand. Just realize that getting a DUI while you are in the military will ruin your career.

my son was pulled over by police. was rainy night about 11.pm .parking lot was very full only way out was to reverse into street center lane. police was traveling in direction my son wanted to go. street has two lanes going east two lanes going west and center lane what law did my son break? reason 4th amendment violated is because in jail son was charge with poss.of control substance which guard found on floor near son .less than 1 gram .hows he in poss if found on floor? he was searched before and nothing found . if not stopped for legit. reason . then could ask for motion to suppress any evidence because 4th amendment violation.

I am going to try my best to answer this question, but as a forewarning, I do not fully understand what you are saying since it seems English is not your native language.

Pulling out of a parking space in reverse is not illegal. What we don’t know is HOW your son pulled out in reverse though. Perhaps he pulled out of the space into the street at a speed that made the officer feel he was being reckless.The officer may have observed your son swerve of felt for some reason that your son didn’t appear to have full control of the car.

Truth be told, it is possible the cop was just being a dick and didn’t like the way your son looked. Unfortunately, it doesn’t really matter. I don’t see a 4th amendment violation.

You don’t mention why your son blew the .06. What made the cop decide to give him a breathalyzer test? Was your son slurring his speech when speaking to the cop? Did he show signs of being intoxicated? We don’t know.

Frankly what we do know is you aren’t telling us the whole story, or at least I know that I am not able to determine the whole story from your post (again I might be misunderstanding you because you don’t speak English well).

Here is what DID NOT happen. Your innocent and perfect son carefully backed his car out into the street and a cop immediately pulled him over, with the breathalyzer in his hand, and arrested him for a DWI. Although, that’s pretty much what your post claims, it is not true. Your son got pulled over for something. Maybe you don’t know what it was because you weren’t there, but he did something more than back out of a parking space to get the attention of the cop. Once the cop came to the car, your son did something which made him suspect he was drunk, and he was.

Which of the officers actions are you concerned might have violated your sons fourth amendment rights? It seems to me that the truth is your son is a complete idiot who was recklessly operating a motor vehicle under the influence and got in trouble but you are looking for a way to get him out of trouble because he’s your son,

EDIT: Judging by your updates it seems you are just looking to exploit the constitution. You’re son is guilty and you’re hoping that the rights we’re given to protect the innocent can be used to shield your son.

He was drunk. He was driving. He was pulled over. He had drugs on him.

You’re trying to prove he shouldn’t have been pulled over, because you think it’s going to protect him from the rest of the charges which followed. Did it ever occur to you that he deserves those charges for being so stupid in the first place?

Oh and by the way, no judge is going to say that a cop shouldn’t have pulled someone over for pulling out into the middle of the street in reverse. That’s reckless driving. Even if you find a judge who may be persuaded to dismiss the charge in another case, they won’t when the driver was drunk.

There are two things you are going to need to accept:
1) Your son is going to be found (or plead) guilty and is going to be punished accordingly. If he doesn’t have a record, it won’t be too bad. If this isn’t his first offense (and I am waiting for that update, hah) the punishment may be more severe.
