My son has a felony marijuana conviction and recently got a DUI. Can he get the felony expunged?
He received probation for the felony and did community service and a drug class. He was almost finished with probation when he received the DUI. His probation has been frozen. What are his chances for NC expungement?

Is it legal for South Carolina traffic courts to give police the power of preosecuting attorney’s?
This is true. If you are pulled over for a DUI, speeding, littering, etc. When you go to court there is no solicitor, only you and the police officer who has the power of a prosecuting attorney, before the judge. The judge follows the suggestions of the police officer. To verify what I am saying is true, call any traffic court in SC.
I got pulled over for throwing a Cigarette butt out the window, which is considered littering. The state fine is $200.00, but the police officer suggested to the judge $540.00, so I had to pay or go to jail. Speeding 20 miles over the speed limit or speeding thrpugh a school zone is a lesser fine.
If you answer, please no lectures on smoking or littering!!!
Most States have a prosecutor/solicitor for trying cases. Police do not have law degrees and what would even prevent from fabricating an offense because of prejudisim, etc. unless it was on video?
Actually this seems to be an advantage to the prosecutor.
You argue that they may lie and you believe some prosecutors don’t?
The advantage is the police officers don’t know evidence rules and aren’t sophisticated in court room rpocedure..this is better than going against a seasoned attorney,
It seems SC doesn’t want to devote prosecutoral resources to traffic citations

Sentencing for Impaired Driving in Michigan?
I was offered a plea bargain from OWI operating while intoxicated to OWVI operating while visually impaired. I did take the plea and it was accepted, due to my clean driving record. Now i have to wait for a sentencing, but i do understand i have to take a mandatory alchohol asessment test. What comes from that? I am seeing a counselor on my own voluntarily, and she confirms i have no drinking problems, nor am i an alcholholic. Can the judge look down on all the positive things i am doing to correct what will not happen again? Has anyone ever been deferred a lower sentence if they have passed a period of probation of 6months or greater? Please notify me of any recent facts i can possibly check out, or what not.

I took one in NJ. It was just a survey, and an interview. It will ask you how often you drink. You will of course answer rarely, and always in moderation. It will ask stupid things like “how often do you blackout from drinking?” . Even if you were a hopeless drunk you could get through it by answering deceptively, and not appearing drunk to the interviewer.

If you’ve been caught for a DUI, does that completely disqualify you from becoming a pilot?
i got a DUI a few years ago and got a PBJ (probation before judgement). Is that an automatic disqualification?
It’s not a disqualification to become a pilot but it will probably be incredibly hard to get a job with a reputable airline someday.

In the United States you cannot have a BAC of over .08%. How strictly is this law enforced? If you have a BAC of .085% will you be arrested?
It is not set in stone the .08 but rather a line to go by. If an officer feels that you are too impaired to operate a motorized vehicle you can be arrested.
You may be able to beat this in court but at least for the evening you will not be on the street
