The time grandparents Michigan statute, MCL 722.27b was amended in 2004 after an earlier version of the law was deemed unconstitutional in the 2003 decision of the Supreme Court of Michigan DeRose v DeRose. In DeRose, the Michigan Supreme Court held that the earlier version of the law violates the fundamental rights of parents to raise to their children because they require the court decide to grant any deference to accommodate parents' decisions about grandparent visits.
The Court's decision was based on the decision of the 2000 U.S. Supreme Court Troxel v Granville, in which the Supreme Court said the state's statutes are not visiting relatives in Washington was unconstitutional because it allowed the trial court to order visit, without granting deference to the decisions of parents, contrary to the fundamental right of parents and the interests of freedom in the management care, custody and control of their children.
After our Supreme Court decided to DeRose, the Legislature amended the statute time grandparents adding some paragraphs in it. As amended, the law requires that a court deciding a petition for grandparent visitation to suppose that the a fit parent's decision to deny grandparents time does not create a substantial risk of harm mentally, physically or emotionally for the child and the grandparent has the burden of rebutting this presumption by a preponderance of the evidence.
