went to the police station. blew a couple tests and they kept messing up then she was asking for her dad or a lawyer to be there for the blood test and they wouldnt let. but still took blood
In many states, 17 years old is considered an adult when it comes to committing a crime.
She will eventually be brought to court, and the offer from the prosecutor will likely be a fine and probation (likely somewhere between 12 and 24 months). She will undoubtedly have a fine and ct costs to pay, as well as probation fees. She will also likely get community service, and have to take an alcohol class and maybe undergo substance abuse counseling.
The whole thing, with the monthly probation fees, will be thousands of dollars in the end.
If there is concern about the legal rights she had during the arrest procedures – hire an attorney. But likely, that will probably be a dead end. But, if you want to spend the money on an attorney – I guess she could try.
SOMETIMES when you hire an attorney, you can get a slightly better deal – the DUI/DWI might get reduced to a lesser charge. That’s not guaranteed. And having worked in a few counties, I have been in some counties where having an attorney makes absolutely no difference. Unfortunately, there is no way for you to know that unless you sat in the court all the time like I do.

My 24 yr old daughter got a DUI in January and just told me last nite that she has her court date in 1 week 4/29. I am devastated that she took so long to tell me and I have no money to pay for an attorney. She has never had a record of any sort and I desperately need to help her somehow and have no one to turn to myself and to make things worse Im in Texas.

Public defenders are assigned, not aquired. She would need to show that she cannot afford an attorney (and this may not apply to traffic violations, mostly criminal matters). She is 24 and therefore an adult. Only she can shape her destiny.

I have a Tennessee license and went to Arizona and got pulled over for a DUI by making an improper right turn. I hired a lawyer to represent me while I am in Tennessee. If my license gets suspended or i get convicted in Arizona will it effect my Tennessee driving record?

Suspended license in CA. Moved to another state.?
I got a dui about 2 years ago. My license was not suspended. The lawyer filed in 10 days. I got an ORDER OF SET ASIDE. When I got this I moved to Arizona. I did the 12 hour classes and paid my money what I owed. I came to CA to visit my mom. Last nite I got pulled over. The cop found a suspended license in CA. My Arizona license is good. So he wrote me a ticket for a suspended CA license. He said it would probably be thrown out. I didn’t know they were suspended. I didn’t renew them when they lapsed. Will I be charged with driving in a suspended license. Thank you.

Phoenix Dui dui question for out of state resident?
I posted this in another area, and not sure I had the right area, so reposting here…
I recently recieved a regular DUI in phoenix, AZ but I am from Ohio. I was advised by a different police acquaintance and his leiutenant in phoenix, that if i do not comply and do NOTHING about by dui, my temporary drivers license they create for me for the DUI in Arizona will be suspended, and I will have a warrant in Maricopa County (where Phoenix is), but that there would be no extradition or anyway it would follow me back to Ohio and show up on my record.
I know this is not the proper way to handle this, but can anyone with a legal background confirm this is a possible approach to avoid the dui being on my record and having to do fine/jail/classes for it?
I was told as long as there is a warrant, there is no conviction – therefore nothing on my record in Ohio and also my drivers license in Ohio will not be effected by this, just my ability to drive in Arizona.

No, I don’t think this is correct. I’m an attorney, but this answer is based on what happened to a couple of folks I know. One friend, in her early 80′s, lost her driver’s license. When she tried to get a new license, a 1983 DWI from New Jersey showed up on her New Mexico report and she had to prove she had cleared it in New Jersey. Essentially the same thing happened with another friend. He had a 20 year old DWI from New York that created a problem for him in New Mexico. I think this is going to be reported to Ohio. It’s true that your bench warrant will only be effective in Arizona and they certainly will not extradite you for this, but I think it will show up on your Ohio Motor Vehicle reporting system. I’d check this information out with an Ohio attorney who does criminal defense. It was a big surprise to me that a 25 year old DWI created a problem for my elderly friend.
