In the state of Utah, a friend of mine(female) was sent to jail for DUI, and the roommate(male)sold her things

She was sent to jail for 90 days. When she got out, she wanted to get her things back. He said she could get in any time. We were supposed to get it today but we just found out that he sold most of it and gave the rest away. We’re in Utah. What are the laws? What should we do? Should we call the cops? Can we have him charged with theft?

The value of the stuff (furniture) is over $5,000. We just found out about this so we have no idea what to do. Please help. Would really like to know what the specific laws are concerning this and if they’re different in different areas. This is Layton, Utah. Thank you very much for the help.

You need to file a police complaint as that is felony theft by conversion as well as larceny from a building. If he had any sort of civil case against her for non payment of rent that may kill your complaint but he would have to have gotten that judgement PRIOR to disposing of the property and you would have rcvd notice in jail DO THIS TOMORROW

If a person has been repeatedly arrested because of DUI then most states in the US will carry out an evaluation. An evaluation is done to assess if there is an alcoholic problem in the person. Extraordinary high doses of BAC on a regular basis indicate alcoholism and hence a proper rehabilitation program or DUI program maybe advocated. Here is a brief rundown on the evaluation process carried out.

Questions typically asked

There are certain typical questions asked in an evaluation process in a DUI case. Questions such as if time is lost from work because of drinking, if drinking is resulting in an unhappy family life, or if the trigger for drinking is because of having a shy or reserved nature etc. maybe asked during an evaluation. There may also be other questions asked such as if the reputation of the person is being risked because of drinking, if a drinking session results in a surge of guilt, if drinking is causing financial problems etc. Sometimes, a person may turn to bad company because of drinking. If family duties are being neglected because of drinking or if it is causing a lack of drive or ambition, then these are all telltale signs of an alcoholic problem.

What are DUI programs?

DUI programs are basically meant for habitual DUI offenders. Depending on the concentrations of BAC in the blood and the number of times the person has broken the law, the period of DUI will differ. The DUI programs help people to reduce their offences by addressing the root cause of the alcoholic problem. There are several DUI programs across states in the US. For example, Wet Reckless is a program that includes offenders with large concentrations of BAC and who have been driving recklessly repeatedly. California has First Offender DUI programs, which are essentially for first time offenders. Such persons are required to serve 3 month or 9 month DUI programs, according to the Alcohol Test and BAC levels in the blood. Then there are 18 month DUI programs, which are mainly for second time offenders while 30 month DUI programs are for people who have offended thrice or more.

Tenure of DUI programs

If a person repeatedly breaks the law because of DUI then he or she will be subjected to DUI programs. The tenure of such programs will vary depending on the number of times the offence has occurred. For a first time offender and for BAC levels below 0.20 the tenure is 3 months while for higher doses of BAC it is 9 months or more. For a second time offender the tenure extends between 18 to 30 months while for a third offence also the period of the DUI program is 18 to 30 months.

Addressing alcoholic problems

Through DUI programs, the offenders are made to realize the change in behavior and characteristics that alcohol induces. Offenders are also made to realize the inherent risks involved with drinking and driving and through a series of positive changes in their lifestyles, they can get rid of the drinking habit.

Dwi/dui Penalties are Harsher Than You Think!

The following is an all too familiar scenario in Virginia:

You are returning home after attending a warm send-off party for one of your colleagues. Many close friends and associates had gathered and you were enjoying every moment of the evening.

At the beginning of the party, you were going slowly since you knew you had to drive back home. But something changed about mid-way through-you lost control.

Before you knew it, the fun and laughter carried you away.

You overdid the drinking part and though you felt that you could safely drive back home, the authorities caught up with you at the intersection just ahead of your house.

Now, you find yourself in the back of a police cruiser, handcuffed and humiliated and wonder “what’s next?”

Well, in case you did not know, the Virginia DWI/DUI laws and associated penalties are tough!

The following is a list of what persons charged with a first offense DWI/DUI face:

- Your license is suspended for 1 year from the date of conviction.
- You face up to $2500 in fines, plus Court costs.
- You have to pay for, enroll in and successfully complete the Virginia Alcohol Safety Action Program (where you are subject to random drug/alcohol tests and have to pay about $300 for the course).
- If your BAC (Blood Alcohol Concentration) is greater than 0.15 but less than 0.20, it is compulsory for you to serve at least a 5-day jail sentence.
- If your BAC is more that 0.20, then the jail sentence is a minimum of 10 days.

If you this is not your first offense of DWI/DUI, then you face additional penalties such as: – Potential Class 6 Felony on your permanent record. – Minimum 20 days of mandatory minimum jail sentence. – Up to three years of license suspension. – Permanent loss of your vehicle.

If you are convicted of DWI/DUI while transporting a minor in the car, you could be sentenced with an additional $500 to $1000 in fines and a minimum of 5 days in jail.

In addition to all of these items, you have to retain a Virginia DWI lawyer (which will cost another $3,000) as well pay for assigned risk automobile insurance (which is extraordinarily expensive)!

Remember-all of these penalties, costs and inconveniences can be avoided by simply taking a cab, having your sober friend drive you home or staying the night at the home of the party host.

While driving on suspended TX license b/f got DWI in NM…?

Ok my b/fs TX license was suspended in 2004 for street racing. In Nov. of 2006 while living in NM he got arrested for a DWI. He has had to do all of the things NM requires him to do, like take a DWI Class, MADD, Probation for a year, ect. ect. Now that he is about to be able to reinstate his license he has found out that he needs to pay TX $200, which is fine, we figured that would happen anyway, but on top of that he has to pay TX another $3,000 – $1,000 a year. We found out that is a “surcharge” and he was suppose to start paying on it in July, but we had no idea. They sent the bill to his address on his old liscense, but why the hell would he have updated the liscense to have a New Mexico address if its a TX license?! I just dont think its fair that both states are punishing him, what should we do? Get a lawyer? Would a lawyer even be able to do anything? Thanks ahead of time!

Texas, and New Mexico are members of the Drivers License Agreement. The DLA require members to report tickets received by motorists to the state where they received a license to drive so as to receive points, and get an insurance hike. Also, when a state suspends the license of a driver who is from out-of-state, the state where the motorist received a license to drive will also suspend their license as well.
