I have a law question.?
Ok so my step-dad is a truck driver. He and his buddy were out in California at a truck stop. Long story short, they got drunk, the friend decided he wanted to drive. My step-dad was in the passenger seat and had to reach for the steering wheel to save the truck 2 times. They got to another truck stop and my step-dad asked someone to help him take away the keys. That other someone called the cops. Cops came; step-dad was out of the truck with the keys. Cops took both to jail, step dad got charger w/public intoxication, friend charged w/DWI. Well now friends lawyer wants my step dad to testify in court the HE was the one driving. Lawyer says the court can’t turn around and charge him with the DWI. Please someone help us out because he has to go to court the end of this month. Thanks for any help and advice.
Ok what is the “friend” just never goes back to California? And does my dad have to be served with subpoena papers?
That would be stupid.
If stepdad did that, then the next thing the prosecutor would do is find that “someone” that witnessed everything. That “someone” will testify that the other guy was driving. Then, your stepdad will be charged with perjury, which is a felony in California.
This would be the extreme scenario, but nonetheless your stepdad would be a fool to agree to lawyer’s plan. In fact, the lawyer is voilating ethics rules by even suggesting this. I would personally report this guy to the bar association.
