Why do defense attorneys never want the jury to see their clients in prison clothes?
Before most defendants enter the courtroom they change into nice looking attire, even though most jury members have seen enough TV to be aware of this arrangement. If you were a jury member and saw a person in prison clothes with a number stencil on, with handcuffs and leg irons would it affect you? Suppose after a “not guilty” verdict, you met up with the person in civilian clothes sharing the elevator wit you. How would you feel?
Courts have ruled the defendants should not be forced to wear prison garb or be shackled unless there is a strong evidence that the defendant would be violent. This is because sitting in prison garb and shackled prejudices the jury.
