I have just received a ticket for OUI in St. Clair Shores michigan.?
I was pulled over however, it was in the middle of a snowstorm. They pulled me over for driving to fast in conditions, and they gave me an option to refuse the PBT. So, i believe i did the roadside tests fairly good. They arrested me and i did take a breath test at the station which was an hour later after being arrested. I did blow a .13 which legal limit is .08. I did get an attorney by the way too. He was telling me he can get it down to IMPAIRED DRIVING. I would appreciate some professional feedback if possible. This is my first offense however, i have a perfectly clean record, what could i possibly face or what not? Would have a perfectly clean record help out alot in the case?
Impaired driving is the best deal you are going to get. If it’s on the table take it. You will have a suspended license for 6 months. After 30 days you can usually request a restricted license to and from work and AA meetings. Most likely you will get probation and community service. Unlikely that you will get jail this time. You will have to pay fines and reimbursement fees to be determined by the judge. I recommend that you start attending AA meetings as a judge is going to order them anyway. It looks alot better if you already are attending AA before he directs you to. Your alternative is to go to trial but you won’t beat a drunk driving charge. Juries don’t go easy on drunk drivers. I’ve made over 100 Drunk driving arrests, two went to trial and both were found guilty. Hope this opened your eyes…designate a driver.
Trooper: Actually now under the new law in Michigan, impaired driving is now considered a prior offense when going for a 2nd and 3rd offense.
