Driving under the influence is a common problem in today's world. No medical evidence is sometimes difficult to determine whether the driver of the vehicle stopped drinking and that police officers use a variety of field sobriety tests. It is important to remember that before using the evidence, the police must have sufficient grounds to stop his vehicle. A police officer may arrest a driver if he or she is driving strangely or violating the rules of the road. If after the officer smells alcohol or have reason to believe the driver is drunk he is entitled to ask the driver to pass some tests.

Field sobriety tests are "evidence of divided attention ", which theoretically test the suspect's ability to perform the kind of mental and physical multitasking that is required to operate an automobile. In general, they are among the most common tests used by police officers:

– The horizontal gaze nystagmus test. Despite a name fear is a simple look test, the person must follow a moving object with eyes to determine the characteristic of eye movement response. If the person is sober, he or she will be able to track the object smoothly, if not shake the eyes as we continue to object.

– The Walk-and-Turn test is when a person must walk heel-toe in a straight line.

– A leg test is simply standing on one leg.

– Modification position-of-care (also called the Romberg test). The suspect must stand with feet together, head tilted back and eyes closed during thirty seconds.

– Finger-to-nose test. The suspect must tip your head back, closing his eyes closed and touch the tip of the nose with the tip the index finger.

– Alphabet Test. The driver must recite all or part of the alphabet, but it is believed that alphabet must be recited backwards, however this is not does, because even the sober people are sometimes unable to do this.

– The driver must touch each finger thumb to count from one to four and back with each contact.

– The driver must count backwards from a number like 30, 50 or 100.

– The driver must look at a flashlight so an officer can observe the reaction of the eyes.

– The final test includes the device called "portable or preliminary breath test or PBT (breathalyzer). The driver must breathe into the device and it will determine how the driver is drunk.

There are two scientific evidence, during these tests the driver is asked to submit blood or urine for scientific proof. While part of this test is performed in the field, not yet considered to be a sobriety test. While some of the tests referred to are considered reliable, there are three main tests recommended that work best in most cases: the horizontal gaze nystagmus test of the walk and turn test and one leg and foot.

How the hell can a person who is arrested on suspicion of DUI has the right to refuse a breathalyzer test?

This is what happened this morning in the former Yankee Jim Leyritz, after allegedly driving drunk and killed a woman in Florida. I've heard this a lot of other people too. If these people are not required to take breathalyzer tests?

From what I hear, refusing to take a lot of encouragement to an admission of guilt.
