What can prosecutors, defense attorneys and judges do to give a fair trial?
How much cooperation between prosecutors, defense attorneys and judges is necessary in order for defendants to receive a fair trial?
The way the system is designed, it’s not really a matter of cooperation. Like the three branches of government, each side has their part in the system, and serve as a check and balance for the other. While the prosecutor thinks in terms of the interest of the public, the defense thinks in terms of the interest of its client, and the judge tries to weigh the balance of both. There is a sense of cooperation in the sense that each side doesn’t operate in absolutes. In other words, the prosecution knows that it must weigh the weaknesses in its case, and the defense knows that a decision to go to trial has risks. Lastly, the judge must consider approaching each case according to its individual facts, while still imposing consistent punishment across the board.
