I recently had a unique opportunity to convince a trial court that an order of time of the grandparents must be reversed.

The time grandparents Michigan statute, MCL 722.27b was amended in 2004 after an earlier version of the law was deemed unconstitutional in the 2003 decision of the Supreme Court of Michigan DeRose v DeRose. In DeRose, the Michigan Supreme Court held that the earlier version of the law violates the fundamental rights of parents to raise to their children because they require the court decide to grant any deference to accommodate parents' decisions about grandparent visits.

The Court's decision was based on the decision of the 2000 U.S. Supreme Court Troxel v Granville, in which the Supreme Court said the state's statutes are not visiting relatives in Washington was unconstitutional because it allowed the trial court to order visit, without granting deference to the decisions of parents, contrary to the fundamental right of parents and the interests of freedom in the management care, custody and control of their children.

After our Supreme Court decided to DeRose, the Legislature amended the statute time grandparents adding some paragraphs in it. As amended, the law requires that a court deciding a petition for grandparent visitation to suppose that the a fit parent's decision to deny grandparents time does not create a substantial risk of harm mentally, physically or emotionally for the child and the grandparent has the burden of rebutting this presumption by a preponderance of the evidence. However, if, under certain exceptions, the two fit both parents object to the visit, his articulation of the opposition effectively creates an irrebuttable presumption that the denial of time grandparents will not create a substantial risk of harm to the child and the grandparents' request must be dismissed.

In my most recent case, after several months and then a friend of the court referral, the court decided in my favor provided that whenever the grandparents of the grandparents should not be forced by court order.

A win some might say, but this victory comes with certain responsibilities attendant. These responsibilities unconsciously instilled in me since I was a kid, but I remember as a student of the American Inns of Court, while that in law school what Judge Patrick Duggan and other senior members try to instill in the students: On a fundamental level, one must be nice to the opposition because they never know when you need a favor returned. In a benevolent and disinterested level, reflect on what actions have an effect on others and if it is for the greater good.

As such, although it reminds me that my client should not enter into any agreement longer or grandparents never assume the grandmother had custody, I recall the important role of grandparents. My client can not want a relationship with grandparents, but the child only receives 2 sets of grandparents and would be a biological charade of denying certain degree of respect or a sign of respect to grandparents. It may be tough but it costs nothing to be human and to act in the best interest of the child or grandchild. If the child wants to spend time with the grandfather of the child should be denied this relationship.

Are the laws on the "custody shared "national level, or specific state? Can someone please help me find a list of all laws and codes relating to custody from here in Indiana?
